SMOKY CABINS

GUEST RENTAL AGREEMENT & HOUSE RULES

(Tennessee Short-Term Vacation Rental)

By signing this agreement, I certify that I am 21 years of age or older and agree to be fully responsible for myself and all occupants and visitors associated with this reservation.


1. RESPONSIBILITY & LIABILITY

I agree to care for the property and return it in substantially the same condition as received, normal wear and tear excepted. I agree to pay for any damage, loss, excessive cleaning, or rule violations occurring during my stay, including reasonable repair, replacement, administrative, and collection costs, including attorney's fees where permitted by Tennessee law.

I understand that Smoky Cabins acts solely as a rental agent for the property owner and makes no warranties except as required by law. To the fullest extent permitted by Tennessee law, I release and hold harmless Smoky Cabins and the property owner from liability for personal injury, death, or loss of personal property occurring on the premises, except where caused by willful misconduct or gross negligence.


2. OCCUPANCY, PARTIES & ILLEGAL ACTIVITY

  • Maximum occupancy is strictly enforced.

  • NO PARTIES, EVENTS, OR GATHERINGS of any kind are permitted.

  • NO illicit or illegal drug use is allowed anywhere on the property.

Violation of this section constitutes a material breach of this agreement and will result in immediate eviction without refundIllegal activity will be reported to the appropriate authorities.


3. NOISE & QUIET HOURS

This property is located in a quiet residential mountain area.

  • Quiet Hours: 10:00 PM - 8:00 AM

  • Excessive noise, loud music, yelling, or amplified sound is not permitted at any time, including daytime hours.

Any noise complaint--from neighbors, HOA, management, or monitoring services--may result in immediate eviction without refund. Guests are responsible for the conduct of all occupants and visitors.


4. PETS & ANIMALS

Pets are strictly prohibited. No animals of any kind are permitted on the property except trained service animals as defined by applicable law.

  • Emotional support animals, therapy animals, and companion animals are NOT permitted.

  • Guests traveling with a service animal may be required to confirm that the animal is trained to perform a specific task related to a disability, as allowed by law.

If an unauthorized animal or evidence of an animal (including hair, odor, waste, or damage) is found on the property, the guest agrees to charges up to $1,000, which may include additional cleaning, ozone/odor treatment, damage repair, and potential loss of future rental income. Guest agrees not to dispute such charges.


5. SMOKING & VAPING

Smoking or vaping of any substance is strictly prohibited inside the cabin. Detection of smoke or vapor odors will result in a minimum $500 remediation fee, plus additional costs if required.


6. CLEANING & DEPARTURE REQUIREMENTS

At departure, guests must:

  • Place dirty dishes in the dishwasher and start it (or wash and put away dishes if no dishwasher)

  • Leave beds unmade

  • Place used towels in the shower

  • Return furniture to original locations

Excessive cleaning, trash removal, or furniture moving may result in additional charges starting at $50, depending on severity.


7. HOT TUB USE (IF APPLICABLE)

Use of the hot tub is at your own risk. Hot tubs are professionally serviced between guests. Guests are advised to:

  • Run the hot tub 10-15 minutes before use

  • Shower before and after use

  • Follow all posted hot tub rules

Hot tub covers are not designed to support weight. Damage may result in charges up to $450.

Guests acknowledge that during same-day turnovers, especially in winter, hot tubs may not reach full temperature on the first night.


8. CANCELLATIONS, REFUNDS & TRIP INSURANCE

  • Cancellations 30+ days prior to arrival may receive a refund minus a $50 service fee plus tax

  • No refunds within 30 days of arrival unless nights are successfully rebooked
    (Rebooked nights refunded minus $50 plus tax)

  • No refunds for early departure, weather, power outages, or road conditions

Guests are strongly encouraged to purchase trip insurance. Coverage may be obtained at www.insuremytrip.comand may provide protection for qualifying cancellations, interruptions, or delays.

Failure to purchase trip insurance does not alter or override Smoky Cabins' policies.


9. MOUNTAIN, WEATHER & ACCESS DISCLOSURES

Guests acknowledge that:

  • Mountain roads may be steep, narrow, winding, or temporarily impassable

  • 4-wheel drive vehicles and/or snow chains may be necessary, especially in fall and winter

  • Wildlife and insects (including bears and ladybugs) are common

  • Storms may cause power outages, limited water service, or road closures

Guests further acknowledge that:

  • Smoky Cabins does not provide transportation

  • If guests are unable to access the cabin due to road or weather conditions, Smoky Cabins is not responsible for transportation, towing, relocation, or alternate accommodations

  • Inability to access the cabin due to road or weather conditions is not grounds for a refund


10. DAMAGE WAIVER VS. SECURITY DEPOSIT

Reservations may require either a Damage Waiver or a Security Deposit.

Damage Waiver

If charged, the Damage Waiver provides limited coverage for accidental damage only, up to the stated amount. It:

  • Is not insurance

  • Does not cover intentional damage, negligence, excessive cleaning, missing items, pet violations, smoking violations, or rule violations

  • Does not limit guest responsibility for damages exceeding the waiver amount

Security Deposit

If required, the Security Deposit may be charged or authorized on the card on file and used to cover damages, missing items, excessive cleaning, violations, or fines permitted by this agreement.

Guests remain fully responsible for all damages, regardless of Damage Waiver or Security Deposit status.


11. RESERVATION TERMS

  • Rates are guaranteed once confirmed

  • Taxes are subject to change

  • A valid credit card must remain on file

  • Smoky Cabins reserves the right to relocate guests to a comparable property if necessary


12. ENFORCEMENT & GOVERNING LAW

Violation of any term of this agreement may result in fees, immediate eviction without refund, and/or legal action.

This agreement shall be governed by and construed in accordance with the laws of the State of Tennessee.


ACKNOWLEDGMENT

By signing below, I confirm that I have read, understand, and agree to all terms of this Guest Rental Agreement and acknowledge that failure to comply may result in financial penalties, eviction, or legal consequences.


~ That pursuant to the provisions of the Tennessee Code Annotated, Title 47, Chapter 18 and Title 62, Chapter 13, Sections 62-13-104(b)(3), Subdivision (D0(I)Smoky Cabins Vacation Rentals, LLC. discloses the following as policy: "All advance rent deposits, damage fees, taxes, and balance of rent due are deposited into a bank escrow account. These deposits are considered income to Smoky Cabins upon receipt and may be used immediately. Any refund considerations are expensed from the general books of Smoky Cabins.
