Rental Contract
You must read and agree to this contract before your booking is completed. After reading the contract below, click the complete booking button at the bottom of the form to complete your on-line booking.
Please read the following rules & regulations of Smoky Cabins. The guest is responsible for knowing the rules and regulations and adhering to them.
I,
the undersigned, am 21 years of age or older and understand that I will
be responsible for all long distance calls and the care of the property
being rented, and agree to return said property to Smoky Cabins in the
same condition, excepting normal wear and tear, as when first rented to
me. I agree to pay for any damage (including reasonable attorney’s fees
incurred for collecting same) to the property and contents during the
stay, and that I will not hold Smoky Cabins responsible for any injuries
or accidents occurring at the property or for the loss of money,
jewelry, valuables, or personal property of any kind. I also understand
that Smoky Cabins is not the owner of the property being rented, but is
acting only as a rental agent for such actual owners, and therefore it
makes no warranties as to the condition of the premises. Maximum occupancy is enforced. Failure to comply may cause you to be
evicted. Tennessee law TCA SECP 62-7-107, provides that the procuring of
accommodations under false pretenses is a crime punishable by fines up
to $500.00 and/or imprisonment up to 90 days. There are no refunds for
checking out early. Four wheel drive vehicles and/or snow chains are
recommended during winter months.
CLEANING
Upon your departure, we expect to have to sweep, mop, change bedding, clean & sanitize bathrooms & kitchen, etc. If there is a dishwasher, please put all dirty dishes in it and start it. If there is no dishwasher, please clean dishes and put them away. Leave beds unmade and put dirty towels in the shower. Please move furniture back to its original position. We do not expect to have to pick up or take out garbage, clean dishes or move furniture. A minimum fee of $50 will be charged if excessive cleaning is required.
REFUNDS
We do not own
the cabin you have rented. The cabins are privately owned, and we act as
the rental agent. No refunds due to early departure or weather. 4 wheel
drive vehicles and/or snow chains are recommended for the winter
months. No transportation is available to and from your unit. We reserve
the right to move you to a comparable unit should the one you reserved
become unavailable.
CANCELLATIONS
In
order to receive a refund of your advance deposit/payment, you must
contact us in writing (email address: reservations@smokycabins.com) at
least 30 days prior to your arrival. A service fee is deducted from all
refunds ($50 plus tax). There are NO refunds on cancellations within the
30 day period prior to your arrival date.
*Within 30 days - whatever
dates we can rebook, this is the amount that we will refund back (-$50).
Example: if you had 5 nights & we rebooked 4 nights = you will be
refunded 4 night+tax+cleaning fee - $50 plus tax cancellation fee.
PETS
We do not accept pets in any of cabins without specific written approval from management. Alone at Last, Bear's Den, Bearfoot, Cades Cove Hideaway, Holy Smokes, River Bend, River Dreaming, Whiskey in the Woods, and Wildwood Cottage are the only cabins that we allow pets in and only with specific approval from management with the following information: dogs name, breed, & weight. Once you get specific written approval, you must agree to our pet policy which will appear below. If we find a pet or evidence of a pet having been in a non-pet friendly property, there will be a $1000 fine charged to the card on file that guest agrees to pay and will not contest.
Only those dogs that
have specific and formal training as a SERVICE animal will be allowed in any of our other cabins. Emotional support animals are not accepted in non pet friendly cabins.
SMOKING
Smoking
is NOT ALLOWED in any of our cabins. If we smell smoke inside of your
cabin upon your departure, you will be charged a $500 fee for smoke
smell removal. NO EXCEPTIONS.
RESERVATIONS
Accepted
up to one year in advance and confirmed rate will be guaranteed. Rates
are subject to change without notice unless confirmed. Primary renter
must be a minimum of 21 years of age and be staying in the cabin. Thirty
Three Percent (33%) deposit required on all rentals, with remaining
balance due in full 2 weeks prior to arrival by personal check,
travelers check, money order, Master card, Visa, American Express or
Discover. Sorry, no pets, group parties or overnight guests in excess of
unit’s published sleeping capacity. The tax rate is currently 14.75%
but is subject to change. Must have major credit card on file for
reservations. Maximum occupancy enforced — violators will be evicted

HOT TUBS
This applies only to cabins that have hot tubs. To determine if your cabin has one, please check the amenities for your cabin.
USE OF THE HOT TUB IS AT YOUR OWN DISCRETION AND RISK. Our hot tubs are professionally cleaned and chemically treated after each guest. However, to make your hot tub experience safer from bacteria, we advise you to run the hot tub between ten to fifteen minutes before entering the hot tub. Please review the hot tub rules with each member of your group. The rules are posted at the hot tub. Hot tub use is strictly at your own choice/risk. By using the hot tub, and by signing the rental agreement, you are absolving Smoky Cabins and the cabin owner of any and all responsibility related to the hot tub or its use.
Persons
who have high blood pressure, skin sensitivities, or who might be
pregnant are strongly urged not to use a hot tub. If in doubt, please
consult with a physician prior to using the hot tub. Hot tubs can cause
your blood pressure to rise if you have been drinking. You should also
never wear jewelry into a hot tub due to the chemicals used. The
chemicals in hot tubs can also affect color-treated hair or damage
swimsuits. Each guest should shower before and after using a hot tub to
remove any bacteria they have encountered.
Hot tub covers are for insulation purposes
and are not designed to support a person or persons. DO NOT STAND OR SIT
ON HOT TUB COVERS, they will break and you may be charged up to $350.00
for replacement. Remember when not using the hot tub, leave cover on so
hot tub will stay warm. If you have any questions on how to operate the
hot tub, please call during office hours for assistance.
***Hot Tub Readiness - If you are
arriving on the same day that another guest leaves your cabin, your hot
tub may not be warm enough to use on your first night. We may empty,
sanitize each hot tub between guests and refill them with tap water. In
winter months, the water temperature could be as cold as 40 degrees and
therefore, takes hours to warm up to usable temperatures.

That pursuant to the provisions of the Tennessee Code Annotated, Title
47, Chapter 18 and Title 62, Chapter 13, Sections 62-13-104(b)(3),
Subdivision (D0(I)Keith & Cathy Moore d/b/a Smoky Cabins discloses
the following as policy: "All
advance rent deposits, damage fees, taxes, and balance of rent due are
deposited into a bank escrow account. These deposits are considered
income to Smoky Cabins upon receipt and may be used immediately. Any
refund considerations are expensed from the general books of Smoky
Cabins.

1. My dog(s) will not be allowed on the cabin furniture unless I provide a blanket for my pet to lay upon.
2. My dog(s) will be on a flea & tick maintenance medication.
3. My dog(s) is house trained and will not potty in the cabin.
4. My dog(s) will be crated if left in the cabin alone.
5. I understand that if my dog(s) causes any damage to this cabin, I will be responsible for any and all repair costs.
6. I will pay additional cleaning costs if my dog(s) leaves an excessive amounts of dog hair throughout the cabin.
